Introduction

Basic information regarding the protection of personal data transferred to Emira Fresh Food is set out below. In order to fulfil the disclosure obligation arising from Article 10 of Law No. 6698 on the Protection of Personal Data (“KVKK”), Emira Fresh Food presents the following statements to the attention of our customers and of third parties using our website and/or mobile applications. Emira Fresh Food reserves the right to update this notice at any time in line with changes in the applicable legislation.

1) Legal basis for collecting personal data

Several laws regulate the use of our customers' personal data. Foremost, the KVKK sets out the principles for protecting personal data. Law No. 6563 on the Regulation of Electronic Commerce also contains provisions on the protection of personal data. Turkish Criminal Code No. 5237 additionally provides criminal sanctions in certain cases.

Separately, collection and use of data is required in order to fulfil our obligations arising from Consumer Protection Law No. 6502 and the Distance Contracts Regulation.

2) Methods of collection

Data provided by customers transacting through our website or mobile applications is processed by Emira Fresh Food in accordance with customers' consent and the provisions of the legislation.

Our website uses cookies. A cookie is a file, mostly consisting of letters and numbers, stored on the browser or hard disk of the device in use, allowing that device to be identified.

In order to serve visitors better and within the framework of our legal obligations, your browsing information will be collected, processed, shared with third parties and stored securely, on condition that it is not used outside the purposes and scope set out in this notice.

3) How website cookies are used

Two types of cookie are used: session cookies and persistent cookies. Session cookies are temporary and valid only until you close your browser. Persistent cookies remain on your hard disk until you delete them or they expire.

Cookies are used to remember your preferences and personalise your use of the site. They are also used to determine how you use the site, including where you connected from, which content you viewed and the duration of your visit.

4) Purposes for which personal data is used

Where and to the extent permitted by legislation, Emira Fresh Food may record, store, update, disclose to third parties, transfer, classify and process your personal information.

Your personal data is used to: verify the identity of the person transacting; record address and other necessary details for contact; contact customers regarding the terms, current status and updates of the contracts we conclude; prepare all records and documents forming the basis of the transaction, electronically or on paper; fulfil obligations undertaken under those contracts; and provide information to public officials on request and as required by law in matters of public security.

It is also used to provide a better experience, inform customers about products that may interest them and convey campaigns; increase customer satisfaction and support customer-base analysis; make recommendations through our contracted institutions and solution partners; evaluate complaints and suggestions; and fulfil our legal obligations and exercise our rights arising from applicable legislation.

5) How your personal data is protected

Personal data shared with Emira Fresh Food is under Emira Fresh Food’s supervision and control. In its capacity as data controller, Emira Fresh Food has assumed responsibility for establishing the necessary organisation and for taking and adapting technical measures to protect the confidentiality and integrity of the information, as required by the applicable legislation. Aware of this obligation, penetration tests are carried out at periodic intervals in accordance with international and national technical standards on data privacy, and our data-processing policies are kept updated.

6) Is your personal data shared?

Sharing of customers' personal data with third parties takes place within the framework of the customer’s consent, and as a rule personal data is not transferred to third parties without our customer’s approval.

However, personal data is shared with courts and other public institutions due to, and limited to, our legal obligations. In addition, personal data is transferred to contracted third parties in order to provide the services we have undertaken and to carry out quality control of those services.

The necessary technical and legal measures are taken to prevent violations of rights during transfer to third parties. Nevertheless, Emira Fresh Food is not responsible for breaches arising from the data-protection policies of the third party receiving the data, or occurring within that third party’s area of risk.

7) Your rights under the KVKK

Under the KVKK you have the right to: (a) learn whether your personal data is being processed; (b) request information if it has been processed; (c) learn the purpose of processing and whether it is used in accordance with that purpose; (d) know the third parties to whom it is transferred domestically or abroad; (e) request correction if processed incompletely or incorrectly; (f) request erasure or destruction within the conditions set out in Article 7 of the KVKK; (g) request notification of the actions taken under (e) and (f) to the third parties to whom the data was transferred; (h) object to a result against you arising from analysis exclusively by automated systems; and (i) claim compensation if you suffer damage due to processing contrary to the KVKK.

8) Keeping up with legislative changes

The rights you hold under the KVKK are Emira Fresh Food’s obligations. We process your personal data with this awareness and to the extent required by legislation. Should there be legal changes, we will update the information on this page in line with the new legislation, and you will be able to follow those updates from this page.

9) Keeping data accurate and up to date

Under Article 4 of the KVKK, Emira Fresh Food has an obligation to keep your personal data accurate and up to date. Accordingly, our customers need to share accurate and current data with us. Should your data change in any way, please contact us through the channel below to update it.
